Terms of Service
These terms apply when you engage Form & Scholar (Ivan Makarin, NIE Z3410947Y) for admissions advice or interview preparation. Please read them before booking. By confirming a booking, you agree to them.
1. Our services
We provide advice and preparation for admission to UK independent schools, as described on our website and confirmed to you in writing before you book. All sessions take place online by video. The exact contents of each package, its price and the schools covered are set out in our booking confirmation.
2. No guarantee of admission
Admission decisions are made solely by schools. We will give honest advice and work to improve your child's preparation, but we cannot and do not guarantee a place at any school, and fees are not refundable because a school does not make an offer.
3. Fees and payment
Fees are stated in pounds sterling, per child and per admissions cycle. Individual sessions are paid before the session. Packages are paid in full when you book, unless we agree an instalment plan in writing. Fees do not include school registration or test fees, travel, or any other third-party costs.
4. Your right to cancel
If you are a consumer, you may cancel within 14 days of your booking confirmation without giving a reason, by emailing hello@formandscholar.com. If you ask us to start work during those 14 days and then cancel, we will refund what you paid minus a proportionate amount for the services already provided. If the service has been fully provided within the 14 days at your request, the right to cancel no longer applies.
5. Rescheduling and missed sessions
You can reschedule a session free of charge with at least 24 hours' notice. Sessions cancelled with less notice, or missed, count as delivered. If we need to cancel a session, we will offer a new time or a refund for that session.
6. Ending a package early
After the 14-day cancellation period, you may end a package at any time by email. We will refund the value of any sessions not yet delivered, minus any work already completed on written materials and planning.
7. Your responsibilities
- Give us accurate information about your child and the schools you are considering.
- Meet school deadlines for registrations, tests and payments. We will remind you of key dates, but submitting applications and paying school fees remain your responsibility.
- For children under 18, ensure that a parent or guardian is at home and reachable during online sessions.
8. Safeguarding
Sessions with children are conducted professionally and only through agreed video platforms. We do not record sessions without the prior consent of a parent or guardian, and we do not contact children through private channels without a parent's knowledge.
9. Materials
Feedback reports, plans and other materials we prepare are for your family's private use and may not be shared commercially.
10. Liability
Our total liability to you in connection with our services is limited to the fees you have paid us. Nothing in these terms limits liability that cannot be limited by law, or your statutory rights as a consumer.
11. Personal data
We handle personal data as described in our Privacy Policy.
12. Law and disputes
These terms are governed by Spanish law. If you are a consumer, you also keep the protections of the law of the country where you live, and you may bring a claim in the courts of that country. We will always try to resolve any concern informally first; please contact hello@formandscholar.com.
